End User License Agreement
In short: when you buy one of our games on Steam, you get a personal licence to play it. You may stream it, make videos of it and earn money from them. You may not copy, resell or crack it, or cheat against other players. Your legal rights as a consumer are never limited by this agreement.
1. This agreement
This End User License Agreement (“EULA”) is an agreement between you and AXIOMIC LTD, a company registered in the Republic of Cyprus under number HE 480260, with its registered office at Charalampou Mouskou & Grigori Afxentiou 20, Athinodorou Business Center, Floor 3, Office 306, 8010 Paphos, Cyprus (“we”, “us”). It applies to every game we publish under the name Axiomic Games, including its updates, downloadable content, soundtrack and other materials supplied with it (the “Game”).
By installing or playing the Game you accept this EULA. If you do not accept it, do not install or play the Game; you may ask Valve for a refund under Steam’s refund policy (see section 8).
The Game is sold and delivered through Steam. Your use of Steam, including your purchase, payment, Steam account and any refund, is governed by the Steam Subscriber Agreement between you and Valve. This EULA adds our terms for the Game itself. If the two conflict on a point about the Game, this EULA applies to that point.
How we handle personal data is explained in our Privacy Policy.
2. Your licence
The Game is licensed, not sold. Subject to this EULA, we give you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game, through your Steam account, for your own non-commercial entertainment, on computers you own or control, as allowed by the Steam Subscriber Agreement (including Steam Family Sharing where Steam offers it).
3. What you may not do
Except where this EULA or the law expressly allows it, you may not:
- copy, sell, rent, lend, sublicense, distribute or otherwise make the Game available to others, or use it for commercial purposes (other than videos and streams as described in section 4);
- circumvent the Game’s or Steam’s copy protection or licence checks;
- reverse engineer, decompile or disassemble the Game, except to the extent that the law that applies to you allows it despite this restriction (for example, under the EU Software Directive to achieve interoperability);
- extract, redistribute or sell the Game’s code, art, music, sound or other assets, or use them in other products;
- use the Game or its assets to train, develop or improve any artificial intelligence or machine-learning model;
- create, use or distribute cheats, bots, hacks or exploits that give an unfair advantage in any online or competitive part of the Game, or that harm other players or our services;
- remove or change any copyright, trademark or other notices in the Game;
- use the Game in any way that breaks the law.
4. Videos, streams and screenshots
You may make and share videos, live streams and screenshots of the Game, and you may earn money from them through the platforms you publish on (for example through advertising revenue, subscriptions or donations). We ask that you:
- do not distribute the Game itself or its files, and do not publish material from the Game that we have not yet released;
- do not suggest that we sponsor or endorse your content unless we have agreed to it;
- name the Game in your content where the platform allows it.
We may withdraw this permission for content that is unlawful, hateful or misleading. Music by third parties, if any, may be subject to claims by its owners; the Game’s credits name it.
5. Mods and your content
If the Game supports modifications, you may create and share mods for free, for use with a legitimate copy of the Game, provided they do not contain unlawful content, cheats as described in section 3, or material you do not have the right to use. You may not sell mods unless we allow it in writing. Mods published on the Steam Workshop are also subject to Valve’s terms.
You keep the rights in content you create. If you send us content (for example a level, a suggestion or a bug report), you allow us, free of charge, to use it to develop and improve our games, without any obligation to use it.
6. Updates and online features
We may provide updates, patches and new content, which Steam may install automatically. We supply the updates needed to keep the Game in conformity with this agreement for as long as the law requires. Updates may change the Game, but will not remove its main features unless the law or a security problem requires it.
If the Game has online features, we may need to change or end them. Unless an emergency or the law prevents it, we will announce the end of an online feature at least 90 days in advance in the Game’s Steam news. Single-player parts of the Game that do not need our servers keep working.
7. Ownership
AXIOMIC LTD and its licensors own all rights, title and interest in the Game, including all intellectual property rights. All rights not expressly granted to you in this EULA are reserved. The Game may include third-party software, including open-source software, which is licensed under its own terms; these are listed in the Game’s credits or files.
8. Your consumer rights and refunds
If you are a consumer, you have legal rights under the laws of the country where you live, including, in the European Union, rights when digital content does not conform to the contract. Nothing in this EULA excludes or limits those rights.
Purchases on Steam are refunded by Valve under the Steam refund policy. If the Game does not work as described, you may also contact us at [email protected], and we will try to fix the problem.
9. Health warning
A very small number of people may experience seizures when exposed to certain visual images, including flashing lights or patterns that may appear in video games. Even people with no history of seizures or epilepsy may have an undiagnosed condition that can cause these seizures while playing. If you or anyone in your family has an epileptic condition, consult a doctor before playing. Stop playing immediately and consult a doctor if you experience dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, involuntary movements or convulsions. Play in a well-lit room, sit at a comfortable distance from the screen, and take regular breaks.
10. Warranty
We make the Game with care, but software can contain errors. Apart from the rights you have by law (see section 8), and to the extent the law allows, the Game is provided “as is”, and we do not promise that it will be free of errors, run without interruption, or work on every computer that meets its stated system requirements.
11. Liability
Nothing in this EULA excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for damage caused intentionally or by gross negligence, or for any liability that cannot be excluded or limited by law.
Subject to that, we are not liable for loss that was not reasonably foreseeable when you accepted this EULA, or for loss of data that you could have avoided by keeping backups, and our total liability to you in connection with the Game is limited to the price you paid for it. If you are a consumer, this section applies only to the extent the law of the country where you live allows.
12. Termination
You may end this EULA at any time by uninstalling the Game. We may end your licence if you seriously or repeatedly breach this EULA, after telling you and, where the breach can be fixed, giving you a reasonable chance to fix it. When the licence ends, you must stop playing the Game and uninstall it. Sections 7, 8, 11 and 13 continue to apply after the licence ends.
13. Governing law and disputes
This EULA is governed by the laws of the Republic of Cyprus. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country or of Cyprus. Otherwise, the courts of the Republic of Cyprus have exclusive jurisdiction.
If you have a complaint, please write to us first at [email protected]; most problems can be solved quickly that way.
14. Changes to this agreement
We may update this EULA, for example when the Game, the law or Steam’s terms change. We will publish the new version on this page with a new date and announce important changes in the Game’s Steam news before they take effect. If you do not agree with a change, you may stop playing the Game; your rights as a consumer are not affected.
If a court finds part of this EULA invalid, the rest continues to apply.
